Welcome to Naseeb. These Terms of Service ("Terms") govern your access to and use of the Naseeb mobile application, website, and related products and services (collectively, the "Services").

The Services are provided by Naseeb App LLC ("Naseeb," "we," "us," or "our").

By creating an account, accessing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the Services.

1. About Naseeb

Naseeb is a platform designed to help Muslim adults seeking marriage discover and communicate with potential spouses and access marriage-related resources.

Naseeb provides tools that may include profiles, preferences, recommendations, messaging, audio and video calling, verification features, reporting and blocking tools, and access to coaching or educational resources.

Naseeb does not guarantee that use of the Services will result in a connection, relationship, engagement, marriage, or any particular outcome.

2. Eligibility

You must be at least 18 years old to create an account or use the Services.

By using Naseeb, you represent and warrant that:

You are at least 18 years old.
You have the legal capacity to enter into these Terms.
The information you provide to Naseeb is truthful and accurate.
You are using Naseeb for lawful purposes consistent with the purpose of the Services.
You have not previously been permanently removed or banned from the Services unless Naseeb has expressly authorized your return.

You may not create an account for another person without authorization or impersonate another individual.

We may request additional information or verification where reasonably necessary to confirm eligibility, protect users, prevent fraud, or enforce these Terms.

3. Your Account

You are responsible for maintaining the confidentiality and security of your account and credentials.

You agree to:

Provide accurate and current registration and profile information.
Maintain control of the email address, phone number, and other credentials associated with your account.
Notify Naseeb if you believe your account has been accessed without authorization.
Not sell, transfer, share, or allow another person to operate your account.

You are responsible for activity occurring through your account unless prohibited by applicable law.

Naseeb may use email, phone verification, one-time passcodes, device information, or other authentication methods to protect accounts.

4. Profiles and User Information

Naseeb allows users to create profiles containing information such as photographs, age, location, occupation, religious practices, marriage intentions, preferences, family expectations, lifestyle information, and other details.

You are responsible for the accuracy of information you provide.

You may not knowingly:

Misrepresent your identity, age, marital intentions, occupation, location, or other material information.
Use photographs or videos of another person as though they are you.
Upload or share photographs, videos, or other content featuring another person without any permission required to do so.
Create deceptive or fraudulent profiles.
Misrepresent your relationship status or purpose for using Naseeb.
Provide information that violates another person's privacy or rights.

Certain profile information may be visible to other Naseeb users as part of the normal operation of the Services.

5. Verification

Naseeb may use verification measures designed to promote authenticity and reduce fraud, impersonation, and misuse.

Verification measures may include:

Email verification.
Phone-number verification.
Selfie verification.
Liveness checks.
Comparison of verification images with profile photographs.
Manual or automated profile review.
Other fraud-prevention or account-security measures.

A verification indicator means only that the account completed the verification process associated with that indicator.

Verification is not a background check and does not guarantee a user's identity, character, intentions, criminal history, marital status, religious practice, safety, compatibility, or truthfulness.

Users should continue to exercise appropriate judgment when interacting with others through Naseeb.

6. Matching, Recommendations, and Compatibility Information

Naseeb may recommend or display users based on information such as preferences, profile details, location, deal breakers, religious practices, intentions, activity, or other signals.

Naseeb may also display compatibility indicators, percentages, recommendations, rankings, or similar information.

These features are intended to help users discover potentially relevant profiles. They are not professional assessments or guarantees of compatibility.

Naseeb does not guarantee that:

Recommended users meet every preference you selected.
Profile information provided by another user is accurate.
A recommended person will respond or communicate with you.
Two users are compatible.
An interaction will result in marriage or any other relationship.

Users are responsible for making their own decisions regarding whom they communicate with or meet.

7. Messaging and In-App Communications

Naseeb may allow users to communicate through text messaging, audio calling, video calling, or other communication tools.

You are responsible for your communications and conduct.

You may not use communications through Naseeb to:

Harass, threaten, intimidate, stalk, or abuse another person.
Send unwanted sexual or sexually explicit material.
Solicit prostitution or other unlawful activity.
Conduct scams, fraud, financial schemes, or deceptive activity.
Ask users to send money, cryptocurrency, gift cards, wire transfers, or other payments as part of a scam or deceptive scheme.
Solicit or request bank-account information, payment credentials, passwords, or other sensitive financial information for fraudulent or improper purposes.
Send spam or unauthorized commercial messages.
Promote violence, hatred, or unlawful discrimination.
Attempt to obtain another user's passwords, financial credentials, or sensitive personal information through deception.
Distribute malware or malicious links.
Engage in conduct that otherwise violates these Terms.

Audio and Video Calls

Naseeb may provide in-app audio and video calling so users can communicate without exchanging personal phone numbers.

Technical information related to a call, such as connection information, call duration, device information, diagnostic information, or similar metadata, may be processed as reasonably necessary to provide, secure, troubleshoot, or improve the Services in accordance with our Privacy Policy.

Users may not record another person's audio or video communications through outside tools or devices in violation of applicable law or without any consent required by law.

8. User Content

"User Content" means content you submit, upload, transmit, display, or otherwise make available through Naseeb, including profile information, photographs, biographies, responses, messages where applicable, reports, and other content.

You retain ownership of User Content you create.

By submitting User Content to Naseeb, you grant Naseeb a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display, format, adapt, and transmit that content to the extent reasonably necessary to:

Operate the Services.
Display your profile to other appropriate users.
Provide features you request.
Maintain security.
Investigate reports or potential violations.
Review moderation flags or appeals.
Resolve technical or account-related issues.
Enforce these Terms.
Comply with applicable law.

This license ends when the relevant content is deleted from our systems, except where continued retention is reasonably required for legal, security, fraud-prevention, backup, dispute-resolution, or regulatory purposes.

You represent that you have the necessary rights to submit your User Content and that its use through Naseeb does not violate another person's rights.

9. Prohibited Conduct

You may not misuse the Services.

Prohibited activity includes:

Fraud, scams, or intentional deception.
Impersonating another person.
Harassment, threats, stalking, or intimidation.
Sexual exploitation or non-consensual sexual content.
Hate speech or unlawful discrimination.
Soliciting unlawful goods or services.
Using Naseeb primarily for commercial solicitation or advertising.
Asking users for money or financial assistance in a deceptive, manipulative, or fraudulent manner.
Sharing or requesting bank-account numbers, payment credentials, or similar financial information for improper purposes.
Creating multiple deceptive accounts.
Circumventing a suspension or ban.
Scraping, harvesting, or systematically collecting user information.
Using bots or unauthorized automation.
Attempting to access accounts, systems, or data without authorization.
Introducing malware or interfering with the Services.
Reverse engineering or attempting to derive source code except where applicable law expressly permits it.
Copying or exploiting Naseeb content, software, databases, designs, or features without authorization.
Using another user's photographs, videos, or personal information without permission.
Posting content that infringes intellectual property, privacy, publicity, or other rights.
Using Naseeb for unlawful activity.

We may investigate suspected violations and take appropriate action.

10. Safety and Interactions With Other Users

Naseeb provides tools intended to support a safer community, but we cannot guarantee the identity, intentions, conduct, honesty, or safety of every person using the Services.

Unless we expressly state otherwise, Naseeb does not perform comprehensive criminal background checks on every user.

You are responsible for exercising appropriate judgment when communicating with or meeting another user.

Consider taking reasonable precautions before meeting someone in person, including meeting in a public location, informing someone you trust, and avoiding sending money or sensitive financial information to people you meet through the Services.

Never send money, cryptocurrency, gift cards, wire transfers, or other financial value solely because another user requests it without independently determining that you wish to do so and understanding the risks.

Naseeb is not responsible for the conduct of individual users except to the extent responsibility cannot legally be excluded.

11. Reporting, Blocking, Moderation, and Appeals

Users may have access to tools for reporting or blocking other users.

We may review reports, relevant User Content, account information, technical information, moderation signals, and other information reasonably available to us to determine whether activity violates these Terms or poses a safety, security, fraud, or legal concern.

Naseeb may, at its discretion and subject to applicable law:

Warn a user.
Restrict account features.
Remove or limit content.
Require additional verification.
Temporarily suspend an account.
Permanently terminate an account.
Preserve relevant records.
Cooperate with law enforcement or legal authorities when required or appropriate under applicable law.

Submitting a report does not guarantee a particular outcome.

To protect privacy, security, and the integrity of investigations, we may not disclose all information regarding actions taken against another user.

Appeals

Naseeb may provide a process for users to request review of certain account suspensions, restrictions, or terminations.

An appeal does not guarantee that an account will be restored or that an enforcement decision will be changed.

We may decline to reconsider repeated appeals, abusive requests, or matters previously reviewed unless new relevant information is provided.

12. Coaching and Marriage-Related Resources

Naseeb may provide users with access to premarital coaching, marriage education, or related resources offered by independent nonprofit organizations, coaches, or other third-party service providers.

Unless expressly stated otherwise, these providers are independent from Naseeb. Their availability through the Services does not create a partnership, joint venture, agency, employment, or similar legal relationship between Naseeb and the provider.

Any coaching fees are charged for services provided by the applicable coach or organization. Naseeb App LLC does not retain or receive any portion of coaching fees or coaching revenue.

The applicable provider is responsible for the coaching or educational services it provides, including its availability, qualifications, scheduling, cancellation policies, and service-specific terms.

Marriage coaching or educational content available through Naseeb is not automatically a substitute for medical care, mental-health treatment, psychiatric care, legal advice, financial advice, or emergency services.

If you are experiencing an emergency or believe someone is in immediate danger, contact the appropriate emergency service or authority.

Naseeb does not guarantee the outcome of coaching or other third-party services.

13. Fees and Payments

Core Naseeb matchmaking features may be offered without a subscription or platform fee.

Certain optional services, including coaching or other future offerings, may carry separate charges.

If you purchase a paid service, you agree to the pricing and payment terms disclosed before completing the transaction.

Payments may be processed by third-party payment providers or applicable app stores. Their additional terms may apply.

We may introduce, remove, or modify optional paid features in the future. Any applicable charges will be disclosed before you are charged.

14. SMS and Electronic Communications

By providing your phone number, you consent to receive communications reasonably necessary to provide the Services, which may include:

Authentication codes.
Account-verification messages.
Security alerts.
Important service notices.

Message and data rates may apply depending on your carrier and plan.

Providing a phone number for authentication does not, by itself, constitute consent to receive unrelated marketing text messages where separate consent is required by law.

By using the Services, you also agree that Naseeb may provide notices electronically, including through email, the application, or the website.

15. Privacy

Your use of the Services is also subject to our Privacy Policy, which explains what information we collect and how we use, disclose, secure, retain, and delete personal information.

The Privacy Policy is incorporated into these Terms by reference.

16. Intellectual Property

Except for User Content and third-party materials, Naseeb and its licensors own the Services and associated intellectual property, including software, designs, graphics, databases, trademarks, logos, text, interfaces, features, and other materials.

Subject to these Terms, Naseeb grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for their intended personal purpose.

No rights are granted except as expressly provided in these Terms.

"Naseeb" and related names, logos, branding, and design elements may not be used without authorization except as permitted by applicable law.

17. Third-Party Services

The Services may depend on or integrate with third-party providers, such as hosting, communications, authentication, verification, analytics, payment, or infrastructure providers.

Third parties may have their own terms and privacy practices.

Naseeb is not responsible for third-party services outside our reasonable control, but we remain responsible for our obligations under applicable law.

The Services may also contain links to external websites or services. A link does not necessarily mean that Naseeb endorses or controls that third party.

18. Account Suspension, Termination, and Deletion

You may stop using Naseeb at any time and may request account deletion through available account controls or methods identified in our Privacy Policy.

Naseeb may suspend, restrict, limit, or terminate your account or access to any part of the Services at any time if we reasonably believe you violated these Terms, misused the Services, created a safety or fraud risk, or for other legitimate business, legal, security, or operational reasons, subject to applicable law.

Without limiting this right, Naseeb may take such action if we reasonably believe:

These Terms have been violated.
The account presents a safety or fraud risk.
The account is being used unlawfully.
Verification information is materially false or deceptive.
The account is being used to harass or abuse others.
Suspension or termination is reasonably necessary to protect Naseeb, our users, or third parties.
We are required to do so by law.

Termination may result in loss of access to profiles, communications, account features, or other information associated with the account, subject to applicable data-retention requirements.

Certain provisions of these Terms that by their nature should survive termination will continue to apply, including intellectual-property provisions, disclaimers, limitations of liability, indemnification, and dispute-resolution provisions.

19. Child Safety and CSAE/CSAM

Naseeb is strictly limited to users who are at least 18 years old.

Naseeb maintains a zero-tolerance policy toward child sexual abuse and exploitation ("CSAE") and Child Sexual Abuse Material ("CSAM").

Users may not create, upload, transmit, solicit, possess, distribute, promote, or otherwise engage with content or conduct involving the sexual exploitation or abuse of minors.

This prohibition includes grooming, sexual solicitation of minors, sexualized content involving minors, or attempts to facilitate or normalize such conduct.

Users who encounter suspected CSAE or CSAM may report it using in-app reporting tools or by contacting Naseeb's designated child-safety contact.

Where Naseeb identifies or receives a credible report of prohibited child-safety activity, we may:

Remove relevant content.
Suspend or permanently terminate accounts.
Preserve information as required or permitted by law.
Report suspected CSAM or child exploitation to the National Center for Missing & Exploited Children ("NCMEC") or other appropriate authorities where required or appropriate.

20. Service Availability, Changes, and Events Outside Our Control

We continually develop and improve Naseeb.

We may add, modify, restrict, suspend, or discontinue features or portions of the Services, subject to applicable law.

We do not guarantee that every feature will always be available, uninterrupted, error-free, or available in every geographic location.

Temporary interruptions or delays may occur due to maintenance, software or hardware failures, internet or telecommunications outages, third-party providers, security incidents, natural disasters, governmental actions, labor disputes, power failures, cyberattacks, or other circumstances outside our reasonable control.

To the extent permitted by law, Naseeb will not be responsible for delays, interruptions, or failures caused by events outside our reasonable control.

21. Apple App Store Terms

If you download or access the Naseeb application through Apple's App Store, the following additional terms apply:

These Terms are between you and Naseeb, not Apple.
Naseeb, not Apple, is responsible for the application and its content.
Apple has no obligation to provide maintenance or support services for the application.
To the extent permitted by applicable law, Apple is not responsible for warranties relating to the application beyond any obligations imposed by law.
Naseeb, not Apple, is responsible for addressing claims relating to the application, including product-liability claims, regulatory claims, consumer-protection claims, and intellectual-property claims, subject to applicable law.
Your use of the application must comply with applicable third-party terms, including App Store terms.
Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to your use of the iOS application and may enforce the applicable provisions against you.

Nothing in this section limits any rights you may have under applicable law.

22. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

NASEEB DISCLAIMS WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, NASEEB DOES NOT WARRANT THAT:

THE SERVICES WILL ALWAYS BE AVAILABLE, SECURE, OR ERROR-FREE.
INFORMATION PROVIDED BY USERS WILL BE ACCURATE OR COMPLETE.
ANY USER IS WHO THEY CLAIM TO BE BEYOND THE LIMITED PURPOSE OF PARTICULAR VERIFICATION FEATURES.
ANOTHER USER WILL BE SAFE, COMPATIBLE, OR SUITABLE FOR MARRIAGE.
USING NASEEB WILL RESULT IN A CONNECTION, RELATIONSHIP, ENGAGEMENT, OR MARRIAGE.
COACHING OR EDUCATIONAL RESOURCES WILL PRODUCE ANY PARTICULAR RESULT.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

23. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NASEEB APP LLC AND ITS AFFILIATES, OFFICERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR SIMILAR LOSSES ARISING FROM OR RELATED TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NASEEB IS NOT RESPONSIBLE FOR THE CONDUCT, STATEMENTS, OMISSIONS, OR ACTIONS OF OTHER USERS OR THIRD-PARTY SERVICE PROVIDERS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NASEEB'S AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

THE AMOUNT YOU PAID DIRECTLY TO NASEEB DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
US $100.

THE LIMITATIONS ABOVE DO NOT APPLY TO LIABILITY THAT CANNOT LEGALLY BE LIMITED OR EXCLUDED.

24. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Naseeb App LLC and its affiliates, officers, members, managers, employees, contractors, and agents from claims, liabilities, damages, losses, and reasonable costs arising from:

Your unlawful use of the Services.
Your User Content.
Your material violation of these Terms.
Your infringement or violation of another person's rights.
Fraudulent, abusive, or unlawful conduct through your account.

This section does not require you to indemnify Naseeb for conduct for which indemnification may not lawfully be required.

25. Informal Dispute Resolution

Before beginning arbitration or filing a lawsuit other than an eligible small-claims matter, you and Naseeb agree to make a good-faith effort to resolve the dispute informally.

A party seeking to initiate a dispute must provide written notice describing:

The person's name and account information.
The nature of the dispute.
The facts giving rise to the dispute.
The relief requested.

The parties will have at least 30 days after receipt of the notice to attempt to resolve the dispute before proceeding further.

Notices to Naseeb should be sent to the legal contact identified in Section 30.

26. Arbitration Agreement - United States Users

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Except for disputes eligible for small-claims court and other disputes that applicable law does not permit to be arbitrated, you and Naseeb agree that disputes arising out of or relating to these Terms or the Services will be resolved through binding individual arbitration, rather than in court.

Arbitration is less formal than a lawsuit in court and uses a neutral arbitrator instead of a judge or jury.

The arbitration will be administered under applicable consumer arbitration rules of the American Arbitration Association ("AAA"), unless the parties agree to another arbitration provider or applicable law requires otherwise.

The arbitrator may award the same individualized remedies that would otherwise be available in court to the extent permitted by law.

Small Claims Court

Either party may bring an individual claim in a court of competent jurisdiction that qualifies as a small-claims action instead of arbitration.

No Class Actions

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND NASEEB AGREE THAT CLAIMS WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, REPRESENTATIVE, COLLECTIVE, OR CONSOLIDATED ACTION.

An arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that individual's claim, except where applicable law requires otherwise.

Jury Trial Waiver

TO THE EXTENT A DISPUTE IS SUBJECT TO ARBITRATION, YOU AND NASEEB EACH WAIVE THE RIGHT TO A TRIAL BEFORE A JUDGE OR JURY.

Arbitration Opt-Out

You may opt out of this arbitration agreement by sending written notice to Naseeb within 30 days after you first become subject to this arbitration provision.

Your notice must include your name, the email address or phone number associated with your Naseeb account, and a clear statement that you wish to opt out of the arbitration agreement.

Opting out of arbitration will not affect your ability to use Naseeb.

This arbitration section does not prevent either party from seeking temporary or emergency injunctive relief where permitted by law.

27. Governing Law

These Terms and disputes arising from them are governed by the laws of the State of Illinois, without regard to conflict-of-laws principles, except to the extent applicable consumer-protection or other mandatory laws require otherwise.

For disputes that are not subject to arbitration, you and Naseeb consent to the jurisdiction of the appropriate state or federal courts in Illinois, except where applicable law gives you the right to bring a proceeding elsewhere.

28. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Services, our business practices, applicable law, or other operational needs.

When we update these Terms, we will post the revised version on our website or through the Services and update the “Last Updated” date at the top of these Terms.

Your continued use of the Services after the updated Terms become effective constitutes your acceptance of the revised Terms, except where applicable law requires additional notice or affirmative consent.

For material changes, or where required by law, we may provide additional notice through the app, email, or another reasonable method.

29. General Provisions

These Terms and the Privacy Policy constitute the agreement between you and Naseeb regarding the Services, except where additional terms are expressly presented for a particular service.

If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

Our failure to enforce a provision does not waive our right to enforce it later.

You may not assign your rights or obligations under these Terms without our consent. Naseeb may assign these Terms as part of a merger, acquisition, restructuring, sale of assets, corporate reorganization, or similar transaction, subject to applicable law.

Section headings are for convenience and do not affect interpretation.
